Last Friday night on my way home from the pub I was pulled over and cited for DUI. The police officer had me blow into a tube and announced that I was over the limit although I felt like I was mostly sober. We had been shooting pool all night and had not consumed anything close to a dangerous limit. I had purchased a carton of beer as I was leaving the pub and had given one can to a friend as we were leaving to go home. The police officer spotted the carton of beer was one missing and assumed I had been drinking it while I was driving. I immediately contacted a friend of mine who is a San Diego Attorney and had a consultation with him the next day. After he heard the details of my arrest, he picked up the phone and calls the prosecutor�s office and ordered the breathalyzer be tested. The next afternoon he called to tell me the charges had been dropped. The breathalyzer that was used by the police officer that night was overdue for calibration. It registered so high that I would not have been able to get out of my chair much less into my car. It was obvious that the reading was skewed. Also, the missing can of beer from the carton I had purchased was nowhere to be found empty and therefore the assumption I had drank it while driving was invalid. He handled the whole thing with such ease and confidence that he had me feeling better from the minute we sat down. Everything came off just like he said it would and I just received his bill today. He only charged me for two hours of his time. So, our savings for vacation is still healthy enough to provide our family with some tab away this summer.
